If you have a parent who is aging and beginning to struggle with daily tasks, financial decisions, or health management, you may be wondering whether a legal guardianship is necessary. The answer depends on several factors, including whether your parent has legal capacity, whether they have existing estate planning documents, and whether those documents provide adequate authority to help them.

First: Does Your Parent Have Planning Documents?

Before considering guardianship, check whether your parent has executed a durable power of attorney and a designation of health care surrogate. These documents, if valid and in place, may give you or another trusted person the legal authority to manage their finances and make medical decisions—without going to court. If these documents exist and are sufficient, guardianship may not be necessary.

What If There Are No Documents?

If your parent does not have these documents and lacks the legal capacity to sign them now, guardianship may be the only option. In Florida, guardianship is a court-supervised process that declares a person legally incapacitated and appoints a guardian to make decisions for them.

Signs Your Parent May Need Guardianship

Potential indicators that guardianship may be needed include: inability to manage finances or pay bills; susceptibility to financial scams or exploitation; inability to make safe medical decisions; unsafe living conditions; wandering or getting lost; and failure to take medications appropriately.

Less Restrictive Alternatives
